Plaintiffs Jennifer M. Sabo, formerly known as Jennifer M. Sansone, and Baldemar Orduno, Jr. (collectively “Plaintiffs” or “Class Representatives”), filed a lawsuit titled Sansone, et al. v. Charter Communications, Inc., et al., Case No.: 17-cv-1880-WQH-JLB, pending in the United States District Court for the Southern District of California (the “Lawsuit”). In the Lawsuit, Plaintiffs claim that TWC violated California Labor Code §227.3 and California’s Unfair Competition Law, California Business and Professions Code §17200 et seq. (the “UCL”) by terminating all TWC employees who became employees of Charter in December 2016 (the “Class Members”) without paying them for their accrued TWC vacation hours at the time of their change of employment from TWC to Charter. Defendants TWC, Charter, and their parent corporation Charter Communications, Inc. (collectively “Defendants”) deny that TWC violated California Labor Code §227.3 and the UCL because they claim that, although the accrued vacation hours were not paid at termination, Class Members’ vacation hours were transferred to the Class Members’ new employer, Charter and were paid out by Charter when the Class Members used them at Charter or separated from Charter. Plaintiffs claim TWC’s transfer of Class Members’ vacation hours to Charter was undocumented and illegal, and that TWC still violated California Labor Code §227.3 entitling Class Members to monetary damages. The Court has not decided who is right with respect to Class Members’ claims.
You have been identified as a “Class Member” because, according to Defendants’ records, you: (1) were employed by TWC in the state of California; (2) became employed by Charter without being paid out the vacation hours you accrued at TWC; and (3) did not enter into the Mutual Agreement to Arbitrate in place at TWC between December 10, 2014, and December 15, 2016.
There is no money available now and no guarantee there will be in the future. But you have a choice to make now.
